hey good evening it is May 2nd 5:05 p.m. and thank you for thank you for joining us today a special meeting and I would like to I'm opening the Gen that take roll call actually there is no real so 1.1 called to order already did that one point too so I'd like to ask if there is any public comment on clothes I'm session 1.2 and I'd like for the board to consider for the boards consider having a public comment before possession and after closed session the reason I am requesting this as we have one board member not here and I also would like us to limit here maximum of 20 minutes and then the rest at the end I'd like to suggest that so that way we can proceed to close session and then Weber's past the 20 minutes and go at the end of the meeting after closing I like to propose. Alright so let's see how many people have what continent we have one do 3 4 5 6 that's already 18 minutes before we start public comment I'd like to see you invite superintendent friend to introduce our our you take the mic and in and give us a little bit of a support for this meeting please I believe we have a legal here thank you present tonight we follow through with the aboard action it was taken April 25th to name an attorney or legal counsel to represent the district and all learn and future negotiation conversation about properties in real estate and attorney Stephen McLaughlin who was named in a action on Maple 25th is here and if I could invite him up to the mic to introduce himself to the board and he will be attending the board meeting in its entirety tonight good afternoon board members my name is Steve McLaughlin I'm the legal counsel for the school district our Law Firm aalrr will be representing the school district and all properly related matters so I'll be attending closed session agenda item to discuss property in terms of price and terminals of payments which will be discussed at this topic to review the district's properties and discuss negotiation the potential property related matters I like to invite board if there's any questions you might have can we can we can I get a clarification how does what are the implications of you being here related to the what are those submitted To Us by our Los Angeles attorney the district attorney thank you so yes there is no relation we're not taking any specific action regarding that letter based on the discussion in that letter we decided that legal counsel should be involved in the closed session we're not taking any action directly to address those concerns we've addressed those concerns separately but from now forward the district is designated our Law Firm is illegal Council for the district dealing with property related matters so now there for anything that we discussing clothes section dealing with Bryson terms of payment or involve our firm generally usually me as a representative the school district and legal counsel that we are not specifically taking any action with respect to that letter this is based on the requirements of the law and the steps at The District's going to take and discuss and close session going forward how would you like to proceed we want to go with two minutes and is 86 * 3 is 18 like we got time for everybody so should I close public comment because if we go with 2 then we can keep it open but if we go with 30k at everybody so let's see let's come in and so we will start with Carol I love user Lindsay Carlson Gina anastas and I'd like to remind the audience that today's public comment is on only on closed session items which relate to 2.1 on the agenda until we can begin can you hear me okay okay well I want to talk about the properties that are under consideration and I also wanted a dress attacked at Brookwood when was first brought on I'm a member of the sea back and we did not want Brookwood involved and we've decided we voted it down even though Mr Friend let me go back summer McBride said she was against involving Brookwood with the $200,000 they formed a sub-committee with Debbie Jaime and I believe Quinn subsequent to the app called sort of an emergency Seebeck meeting and they asked us to comment on hiring Brookwood and we voted against it at the end of that meeting mr. Tran said that he had decided his mind was already made up it didn't matter what we said he was going to recommend to the board how to remove Brookwood we said will what's the rush and I think Heather a summer McBride said that and he and Mr Quinn said while the Russians that we have to get this ready for a bond issue of almost a million dollars that would be coming up in 2024 and so there was a Timeless Brookwood property development and the bond issue together and the problem is is I see it that the community is not interested in and is very much against redeveloping the property where the district office and that's the only property on this whole list of properties you have tonight that it makes any sense for redevelopment and in fact in the future already report there's the blueprints already for redeveloping the district property as well as moving the district office over next to the Middle School so I want to say that as distinctly as a community member growing or changing any of our properties is against the law for the educational mission of we are not the district is not in the real estate business nor should it be selling its properties other districts aren't doing this I know Culver City wants to be first in the nation to do this that and the other our educational Mission should be first and we should be focused only on the educational Mission not talking about whether or not we're going to develop properties we should be focusing on fixing the high school not developing Pro that's all I have to say thank you can we and we hear from the next participant I named Lindsay Carlson are you ready okay good evening Carlson and one of your constituents a lawyer and a mother of a teacher and the district currently also hear Brown at conscience I appreciate the knowledge the possibility it was actually yours as board members or the election you're the ones that are bound to follow the Act regarding this meeting itself the one that ran right now actually out of compliance as well because the agenda was not posted 24 hours in advance which would have been at 5 p.m. last night was supposed to sometime between 7:15 and 7:20 machine if you're not familiar with that you can Google it will confirm that non-compliance so you all should have drowned in mediately and hold the meeting when it's properly know what is the substance of the notice itself as More Words which is great but you're still out of compliance beyond me as to why someone didn't even practice in this area but I can read that you guys can't get it right in such an obvious way I'd recommend that you read it for any general opinion 10-2 06 from 2011 particularly the last two paragraphs of that opinion. Her knees are advising on this meeting in that it's properly noticed send them the opinion too and don't let them charge you for reading it if you're really intending to let the superintendent sell off all the district properties right now that seems pretty major but it's something that the public should know and that we shouldn't be discussing in secret that's not what seems like you're breaking the law again so I notice of properly hold an open session at the public thank you am I getting you with public comment we we have legal in the room maybe they can consider that statement of looking into that paragraph and end in as we listen to public comment can I please get a confirmation from our executive team when this meeting was posted in can we please have it in writing thank you that I've heard so teacher speak out against Workforce housing and I believe the desire is to pay them more so that they can choose where they want to live that everybody wants to live by work or live in Culver City I love living here but I understand others may not and they should be given that choice I understand the heart of the matter and wanting to have Workforce housing to give people this lower-cost option but it doesn't seem well-received anyone that I've heard speak up on it friends with some of the teachers I'm very close relationships with my daughter's teachers I like to be involved and help out where I can it just seems to me that nobody wants this and I guess I'm just reply why is there such a thing as a homeowner in this District to great and thanks to that I was able to purchase a condo in Culver City we could have moved to Thousand Oaks and purchased a home SoundPoint into me that my child have an opportunity to be educated in this district and the trade-off was to live in a condo and I'm just really sad that we're here and now I'm understanding there may be a 999 million our bond to cover this Workforce housing if I'm wrong with cross me but that's what I'm understanding the last time I voted on a measure measure K I am not confident how that money is being spent and if it's being spent the way it was intended and what I am said I was voting on so with all due respect to the board and are you have a tough job it's not something I'm willing to take on so I can give you that respect and appreciate that you're doing this and having to listen to All comments but I'm beg please listen to the community we don't want this we don't want Workforce housing I don't want to keep getting taxed to death for these measures that I don't think I'm putting the money should be spent on the teachers and the school infrastructure to show at let me really care about them thank you so much for your time when is not followed with an iPhone and then he saw hi this old parent in the district and I was a proud member of the citizens Bond oversight committee for the last major bond that we had I'm here tonight because I just wanted to point out I do follow the board meeting regularly and the agendas and I did notice that this board meeting this whole session was not properly agendized it was not posted until after 7 last night and this meeting is starting at 5 so with that you shouldn't be having a session per the brown act as we know the brown act the whole purpose is for for work to be done in the sunlight for the public to see and the public should know at least 24-hours hopefully more was going to happen in a school board meeting is extremely important especially if you're going to be talking about something like a bond or raising money for Workforce housing or selling off District property if this is something that people need to know about I just want to remind you that one year ago May 3rd 2022 the city of coal City consultant presented a presentation to the city council for those of you on the school board who may have missed it you can look it up May 3rd 2022 and they presented thoughts of a survey and the survey said that over half of the people in Culver City did not want a bond or to raise money or did not support Workforce housing in Culver City and also I heard in meeting the union leaders say that teachers and staff do not work Workforce housing what they want is a pay raise so I would like to keep all of this in mind and furthermore if Brookwood is in this meeting I do believe that that is improper because the things that you're going to be talking about respect to buying or leasing properties it's not proper for a close fashion which is supposed to be to provide our negotiator and lawyers of information and the school board and I also have a question as to how Brookwood came to be I can't find any of that information I don't remember any requests for those are anything publicly noticed that would have other companies presenting or asking to be part of something like this but back to my original point of view this meeting is improperly noticed should be halted thank you we proceed to Melissa if you need a little bit time we can go to can I get a point of order before we go to the next speaker just following up on Miss Carlson's comment about the posting of meeting it does appear to be as from what I can tell posted 7:14 last night which means this is less than 24 hours it was posted it was posted at 2 p.m. physically here where the meeting is taking place outside our building it was then posted at 4 p.m. online it was selected as a featured meet after 5 p.m. the star on the app is applied at the selection of feature this is also when folks requesting automatic notification receive an email regarding a public meeting posting if I if I am corrected those are the measures that we need to do to host a special meeting now legal if you have anything to add to that please come forward yeah let me address that really quickly so if we confirmed that it was physically posted an available online prior to 5 or fine so and that's what the text indicated I think we've independently confirm. So as long as the public had access to that notice within 24 hours that were in compliance I will ask death to look into where find it was posted so that we can confirm that. Can we proceed I we can proceed upon public comment but not proceeding with any more than that to the confirmation information thank you okay sorry my microphone was agree with what everyone's previously said regarding this issue I don't think 990 million dollars should be spent on a bond issue especially when taxpayer is it already had to pay enough for parcel K and I'm really worried about this going forward no one in the community really wants this this is been so since day one no one wanted Brookwood we wanted more contracts to be sawdust and you guys kept continuously ignoring us like you do for the brown act violations as well so I'm just still shocked that this is even going forward especially when you have your teeth and your staff to worry about first informal person from Chrome OS and your students and like someone else had before the high school has dire needs and you guys continuously ignore that so pretty money in your pockets is not okay that should be completely asked in continuing to ignore Brown and violations is it's just it's not cool it's not okay and this district is continuously failing its taxpayers residence staff and everyone else thinks hi everyone my name is Deepa Makita thank you board for you know allowing this public comment and just you know agreeing with everyone else and also just to confirm that I myself online received the agenda past 7 p.m. so that was my source of information I was not available boy dogs for me I guess it's hard for me to understand why the district and the school board keeps continuing to move forward with something that there is there's no buying from the community you know it's not supported by the constituents not supported by the parents and Community the teachers and staff there's just so many issues in our school which includes young teacher salaries Morel teacher retention building facilities and just talkin about a measure to everyone else has brought up there was a meeting yesterday of which three of the five members resigned so there is not a good record on you know maintaining taxpayer funds so it it's just the whole process isn't really make sense to any of us the facilities master plan which is presented at the September 2019 board meeting at that time our schools had a rating of c a grade between C and D + 20 19 means that was a few years ago and are our current facilities aren't doing any better so I guess you know we would appreciate it more if the board would turn their focus back to solving all of our we have concerns and pressing issues instead of you know creating new ones. They won't be able to maintain thank you is Alexander yeah thank you can you hear me yes yes thank you board members and superintendent this is so Alexander during my career one of my postings was as a city auditor doing internal audit based on the documentary evidence I have stand up for my risk assessment of the district has now moved from yellow to red I see red flags all over the place it's a sea of red I'm not going to be your Canary in the coal mine I'm going to be like the MGM lion that roared over this point one you have torun questionable Financial record-keeping audits are seriously over 21 case on point the measure k on it to there is a lack of institutional control from the school board case and point board members were using personal emails for district business including this particular matter tonight I'm Workforce housing number 3 there has been flouting of legal and financial regulation one case on point tonight tonight's Brown a legal violation of public notice in for this meeting number for there's a lack of responsiveness the stakeholders from elected board and District administration number five upper management disinterest and lack of knowledge one case on point there was a demonstrated lack of knowledge by the tram last night at the measure K meeting number six failure to Institute best business practices four common functions such as contract management and oversight Chase on point the new Earth contract go on it's all there and my hair is almost on fire over this I'm 65 years old I have the ability to exempt myself from measure K I think I will do that and take an equal amount of money that would go to the give it to the Culver City Education Foundation who I was a trustee for and I have more faith that they will know how to more wealth and money on education in the district and you're showing right now thank you thank you okay I'd like to give time for our staff to let us know where online we can find the posting we can have and while we wait for that I like to consult with legal and the superintendent could I ask you a quick reset so I can so I can chicken do I need okay thank you so much thank you everybody we will now I'm going to read a statement that we prepare for everybody we greatly appreciate the input of our Public public we understand many of our community members opted into the feature to be notified by the automated system on board docs wild at gender available online and at the physical location within the 24 hour.
