Title IX Introduction
Title IX of the Education Amendments of 1972 (“Title IX”), 20 U.S.C. §1681 et seq., is a federal law that was passed in 1972 to ensure that male and female students and employees in educational settings are treated equally and fairly. It protects against discrimination based on sex (including sexual harassment). In addition, Title IX protects transgender students and students who do not conform to gender stereotypes. State law also prohibits discrimination based on gender (sex), gender expression, gender identity, and sexual orientation.
Title IX Rights (CA Education Code 221.8)
The following list of rights, which are based on the relevant provisions of the federal regulations implementing Title IX of the Education Amendments of 1972 (20 U.S.C. Sec. 1681 et seq.), may be used by the department for purposes of Section 221.6:
Title IX Complaints
At time of filing the formal complaint, the Complainant must be
participating or attempting to participate in recipient’s education program
or activity. Students or parents/guardians should report their verbal or written Title IX complaint to a school administrator or the Title IX Coordinator.
If the complainant is dissatisfied with the school-site decision, the complainant may file a written Uniform Complaint Procedures (UCP) complaint directly with the Assistant Superintendent, Educational Services. This will begin the investigation process which must be completed within 60 days.
The District’s Educational Services Department timestamps new complaints of discrimination, harassment, intimidation, and/or bullying when received and provides an acknowledgment letter framing the allegations under the jurisdiction of the Uniform Complaint Procedures (UCP) and referring a complainant to appropriate offices and resources for issues not under UCP jurisdiction. The investigator assigned has 60 calendar days from office receipt to investigate the complaint and to send a letter with findings to relevant parties. The 60-day timeline may be extended only by mutual agreement of the complainant and the District. During the investigative process, the investigator contacts the complainant and other applicable parties requesting data and responses. The District includes an opportunity for the complainant to present evidence or information to support the allegations. The District will ensure that, within 60 days of receipt of the written complaint, the complaint has been resolved and/or investigated and that a written report of findings is issued to the complainant. The written report of the investigative findings contains the allegations, method of investigation, policy, findings, conclusions, appeal options and corrective actions, if applicable.
An appeal of the Assistant Superintendent, Educational Services findings may be made to the California Department of Education's Office of Equal Opportunity (see below).
A discrimination complaint may also be filed directly with the U.S. Department of Education's Office of Civil Rights (see below).
Specific to complaints of sexual harassment:
For purposes of Title IX, sexual harassment is defined as conduct on the basis of sex under one or more of the following:
Sexual Harassment Complaints under Title IX follow a different Grievance Process. The Grievance Process is addressed by the Title IX Team. The team consists of the Title IX Coordinator, an Investigator, a Decision Maker, and Appeal Officer, and an Informal Resolution Process Facilitator. All team members must be impartial, unbiased, and free from conflicts. All team members have been trained in the new Title IX Regulations (to view the training, click on the link at the bottom of this page).
Our District and the Title IX Coordinator are aware of and acknowledge the new Title IX regulations effective August 14, 2020. Our Title IX Coordinator and Team received training on these new regulations on September 10, 2020. Our training materials are available for review under this link. We are in the process of reviewing and revising our Title IX policies and practices, after input from our stake-holders in order to implement a fair, thorough, and impartial Title IX complaint process and District response.
